While this is finally the road to victory that 1199SEIU has been waiting for, it is not final as there could be an appeal from the Kingsbridge side. A quote from a union representative
This is likely to be appealed—–>we are not calling this a final victory rather an important victory on the way to justice. These things do not always move in a straight line therefore we keep doing what we’re doing til its over……our way !!
Here is the main text of the injunction order:
IT IS FURTHER ORDERED that pending the final disposition of this matter by the National Labor Relations Board, Respondent, its officers, representatives, agents, servants, employees, and all persons acting in concert or participation with it or them shall, within five (5) business days of the issuance of this order:
(l) Provide the union with the information it requested by letters dated June 13 and August 3, 2007;
(m) Treat the striking bargaining unit employees as unfair labor practice strikers and, upon their unconditional offer to return to work, reinstate them to their former positions without prejudice to their seniority or other rights and priviledges previously enjoyed, displacing, if necessary any employees hired, transferred, reassigned or obtained, leased, or contracted for through an outside agency to replace them;
Provided, however, that the Respondent shall not be required to reinstate any individuals identified by Respondent on August 18, 2008, as having allegedly engaged in strike misconduct, unless and until it is determined at a hearing before this court, or its designee, according to the procedure set forth below, that such individuals shall be reinstated.
So after reading the full order it basically gives Helen 5 business days to reinstate all the striking members except for the several names she named in court that she claims engaged in striker misconduct.
If I were Helen I would wave the white flag already and just give it up! The hope that she can continue on should be getting dimmer everyday that passes, at least you would think that she can see all the support that 1199 has received from everyone around them.
