Day 146 – Well another Monday and still no end in sight, the strike carries on and it seems like everyone is bending over backward to make this strike continue on. DOH isn’t moving on anything and it seems like the NLRB is following in the DOH’s footsteps, I received news today that the NLRB has granted Kingsbridge’s request to postpone the Unfair Labor Practices trial from August 11, 2008 until September 15, 2008. This is what the third time this is now postponed? Why is it that Helen can just keep delaying the inevitable and nobody seems to care?
I also was told today that Helen is trying to get and appeal from the Appellate Judges that ruled against her. I didn’t think she had any appeals left, but if they deny her appeal she can then seek an appeal from the Appellate Division. This is all unbelievable, just leave 220+ people outside and keep postponing everything! For what reason? The only good thing is while these appeals are going on the eviction remains in effect and can still be carried out after the 30 day stay.
In the court records the jury trial on the landlord’s claim for back rent, which was set for July 15, 2008, has again been postponed. Now I know this doesn’t affect the striking members but it goes to show that everything is just being pushed back further and further. I was told that as long as Helen keeps getting new lawyers the courts will grant postponements so the new lawyer can catch up, if that is the case it could take forever as we all know Helen goes through lawyers like her Prada shoes.
How long do these members have to stay on the picket line? What is it going to take for someone, anyone to do something to end this strike?
Since the Department of health has not responded to our request for information we have now sent a final letter demanding answers, if we do not receive any we will take it as a denial of information and will be then forced to file a lawsuit against the Department of Health. You can see the reverse chronology of letters to and from the Department of Health below including our most recent letter.
- 7/14/2008 – DOH Overdue Foil Request (PDF-Acrobat Reader Required)
- 5/07/2008 – DOH FOIL Part 2 (PDF-Acrobat Reader Required)
- 4/11/2008 – DOH FOIL Part 1 (PDF-Acrobat Reader Required)
- 4/06/2008 – DOH Initial Letter (Request) (PDF-Acrobat Reader Required)
- Open Government Reference (PDF-Acrobat Reader Required)
I will keep you up to date on any correspondence we receive back from Department of Health. The 7/14 letter was faxed and mail to Commissioner Daines today.
Lastly today, although it is Monday there was a police presence here, however the parked cars are still here even at 11:00pm. At this point in the game we are now contemplating sending a letter to the police commissioner to let him know what is going on up here. Perhaps he would be more open to enforcing the laws evenly across the board. Of course you can see any and all correspondence here on the blog.
Till Tomorrow, STAND STRONG!
